Terms of service
These Terms & Conditions outline the agreement between you (the “Client”) and Preciosa Phase (“we”/“our”/“us”) regarding the consignment of product(s) for resale. By consigning your product(s) with us, you agree to the following terms:
1. Consignment Duration
• The initial consignment period is 30 to 90 days, unless otherwise agreed in writing between both parties.
• At the end of the 90-day period, it is the Client’s responsibility to contact Preciosa Phase to determine the next course of action.
2. Delivery of Property, Risk of Loss & Insurance
• All items are consigned to Preciosa Phase on a consignment basis.
• The Client assumes full responsibility for the product(s) until they are received and acknowledged by Preciosa Phase at the designated shipping address.
• The Client is responsible for insuring the product(s) against loss, theft, fire, accidental damage, acts of nature, or any other transit-related damage.
• Preciosa Phase does not bear liability for any loss or damage incurred before physical possession of the product(s).
• Once the product(s) are received and confirmed by Preciosa Phase, all risk and responsibility transfer to us.
3. Post-Consignment Options (After 90 Days)
Following the initial 90-day period, Preciosa Phase and the Client will mutually decide to either:
• A) Return the unsold product(s) to the Client, or
• B) Revise and lower the listed price to continue the consignment.
If the price is revised, the consignment will be extended for an additional 60 days.
4. Return Logistics
• If a product is returned to the Client after the 90-day period, the Client is responsible for all return shipping charges.
• Preciosa Phase reserves the right to return any product at any time, particularly if issues arise regarding product condition, quality, authenticity, or discrepancies from the original agreement. In such cases, the Client will bear the full cost of return logistics.
5. Product Evaluation & Pricing
• Upon receiving your product(s), we will conduct a thorough authentication and quality check.
• A proposed selling price will be shared with you. Only upon mutual agreement on the price will the product be listed for sale.
• If the actual condition of the item does not match what was previously communicated, Preciosa Phase reserves the right to adjust the pricing accordingly. Any changes will be communicated before listing.
6. Product Listing & Visibility
• Consigned product(s) will be professionally photographed and featured across Preciosa Phase’s online and offline sales channels.
• We maintain strict confidentiality and do not disclose the Client’s personal information or the origin of the product(s) under any circumstances.
7. Shipping Responsibility
• The Client is responsible for shipping the product(s) to Preciosa Phase and bears all associated costs.
• We are not liable for any loss or damage incurred during transit from the Client to us.
• Upon receiving the product(s), a confirmation will be sent via email or WhatsApp. This confirmation marks the official start of the consignment period.
8. Product Authenticity
• Preciosa Phase only lists and sells authentic, verified products.
• It is the Client’s responsibility to ensure that all consigned items are genuine.
• If any product is found to be counterfeit.
• The Client is liable to refund the buyer the full purchase amount,
• Bear all related shipping costs, and
• Pay a penalty of INR 5,000 to Preciosa Phase for breach of trust and business costs incurred.
9. Buyer Returns & Cancellations
• In the event a buyer requests a return, cancellation, or refund, we will inform the Client within 7 days of the buyer receiving the product.
• Decisions regarding resolution will be made on a case-by-case basis and communicated clearly with the Client.
10. Right to Refuse
Preciosa Phase reserves the right to decline any product from being listed if it does not meet our standards for quality, authenticity, or market fit.
